TravelChinaGuide.com sets forth the Terms of Use, that apply to your use
of TravelChinaGuide.com and all its affiliate websites. By using this
site, you agree to observe these Terms. This Agreement will be governed
and construed in accordance with the laws of P.R.C.
1. Ownership and Copyright:
Except as otherwise indicated, TravelChinaGuide.com is the owner of the
copyright of all contents (text, images, graphics, animation, audio,
video) contained herein. No part may be reproduced, copied or
transmitted, in any form or by any means (such as electronic, mechanical,
micro-copying, photocopying, recording, storage in a retrieval system or
otherwise) without the prior written permission of TravelChinaGuide.com.

Recently we were obliged to seek judgment in the Beijing No. 2
Intermediate Court following a violation of our copyright by China
Business Associates Inc (owner of www.america-china.com). That
organization had pirated some 24 tour itineraries, 60 articles and 64
photographs from our www.beijingtrip.com site.
In finding in our favor on December 19 2003, the court ordered China
Business Associates to delete the stolen content from their web site,
offer us a public apology and pay compensation.
We draw attention to this judgment so that others may be aware of our
intentions should other violations occur.
2. Use of community columns, such as forum, travel review, photo album,
and member's home pages and the like:
TravelChinaGuide.com website may contain and allow its users to post
messages, reviews and photos of their travel experiences. It is a
condition of your use of the Services that you do not post or distribute
information or material that may be deemed to be:
(i) Unlawful, threatening, libelous, defamatory, obscene, indecent,
inflammatory, pornographic, profane or material that could constitute or
encourage conduct that would be considered a criminal offense, give rise
to civil liability, or otherwise violate any law; or for any other
purpose that is unlawful.
(ii) Advertisement or for commercial purposes of any kind.
(iii) Copyrighted content or material that is used without the express
permission of the owner;
(iv) Content or material that infringes or encroaches on the rights of
others, including, but not limited to, infringement of privacy and
publicity rights and harm to reputation; or
(v) A link to any of the above.
TravelChinaGuide.com reserves sole discretion to decide whether the
content or material is prohibited on the Site and has the absolute right
(but not the obligation) to delete, move and edit content and material.
You are solely responsible and liable for all content posted on and
stored in the website of TravelChinaGuide.com and its all affiliates.
You grant TravelChinaGuide.com and its affiliates a royalty-free,
perpetual, universal, non-exclusive right and license to use, reproduce,
modify, adapt, publish, translate, create derivative works from and
distribute any materials provided by you to TravelChinaGuide.com, through
member pages, message boards, forums and others alike. You are the legal
owner of the copyright to all materials you submit to
TravelChinaGuide.com or that you have permission from the copyright owner

violate the Terms of Use may have their membership terminated, revoked,
services cancelled and their pages and materials, or portions thereof,

not return removed materials to a member. TravelChinaGuide.com is not
responsible for any loss of data resulting from removal of member

TravelChinaGuide.com suggests all members to maintain backup versions of
their pages and materials to guard against losses of any kind.

files, nor is it required to return any data, resulting from
TravelChinaGuide.com' suspension or deletion of data and/or files,
network or system outages, file corruption or for any other reason.
